TERMS AND CONDITIONS OF SALE

Payment of this invoice by the customer constitutes acceptance of all terms and conditions of the agreement between Adelaide Timber Cladding (ATC) and the customer as appears herein.

​

TERMS OF PAYMENT

​

A deposit of 50% of the order value is to be paid before the order is either cut or packed. Your order will not be started until receipt of the 50% deposit. Receipt of deposit or any delivery instructions received by ATC are viewed as acceptance of the terms and conditions.

​

The final payment of 50% is to be paid before delivery. Your goods will not be dispatched until full payment is received unless C.O.D. has been specifically arranged. If full payment is not made before unloading or alternative arrangements are made in writing to ATC, your timber will not be delivered.

​

ATC shall retain legal title of all products and services supplied by it to the Customer until it has received payment in full.

​

DELIVERY

​

Risk, care, and responsibility of goods shall pass to the customer upon collection or delivery. This includes collection by or delivery to a third-party carrier organised by you. ATC will not accept responsibility for lost or damaged goods as a result of a third-party carrier.

​

Timescales for Delivery

​

ATC will provide delivery timescales however times made known to the customer are estimates only. ATC will not accept liability for late delivery. This includes loss or damage occasioned to the customer or others arising from late delivery, non-delivery, damaged goods, incomplete goods or incorrect goods. ATC strongly recommend that you don’t book any tradesmen until your order has been delivered in full and checked over.

Crane Truck Delivery

​

The date for delivery is an estimated and tentative date for delivery only and ATC shall be under no liability for any loss or damage howsoever arising if the services are not delivered by that date. We agree to deliver goods to you on the understanding reasonable access is available.

​

It's your responsibility to be onsite for delivery. Delivery will not be held up if no one is onsite to take delivery. The driver will aim to place the good in a safe and secure place on your property to the best of their discretion.

​

Deliveries are generally kerbside only and placement of timber other than kerbside is at the discretion of the truck driver. ATC will not accept responsibility for damage to property or persons, where the driver has been instructed to place deliveries onsite or anywhere other than kerbside.

​

ATC makes every effort to advise accurate delivery costs, however, we reserve the right to charge for additional costs. Charges for deliveries are charged by time, and prices may vary depending on road conditions.

Hand-unload Delivery

​

At least one person must be available to assist with unloading and to accept delivery. Deliveries are kerbside only and placement of timber other than kerbside is at the discretion of the driver. ATC will not accept responsibility for damage to property or persons, where the driver has been instructed to place deliveries onsite or anywhere other than kerbside.

Arranged Pickups

​

For arranged pickups, the customer and/or third-party carrier must ensure that the vehicle is fit for purpose and can safely carry the load as per DPTI and/or other statutory requirements. A $35 handling fee applies to pick-ups.

​

Storage Fees

​

If no prior arrangements have been made and failure to take delivery of your timbers one month after placing the order, storage fees ($50 /week) will apply.

​

DAMAGED OR DEFECTIVE GOODS

​

Please inspect your timber on delivery. If notified within 5 days, ATC will replace or discount defective or damaged goods, providing it can be proven that the damage or defect was sustained before receiving the goods. Replacement costs or discounts are for materials only and do not include freight or labour.

CANCELLATIONS AND REFUNDS

​

Cancellations of orders are not accepted once delivery has been made.

​

If the order is cancelled before delivery and after being packed or cut, a restocking fee will be charged, taking part or all the deposit paid. A standard restocking fee of 20% of the order is applied however cancellation of ‘Set Length’ or ‘Special’ orders may attract additional costs, and ATC reserves the right to recoup these costs from any deposits held.

Return of goods will only be accepted if such goods are in the original condition as supplied. No claims are allowed after 5 days from receipt of goods.

PRODUCT SPECIFICATION

​

It is the responsibility of the customer and/or contractor to do their own research to ensure products are suitable for the application. This includes handling, installation and maintenance as per the manufacturer’s guidelines. ATC will offer advice where possible however it is important to refer to the Manufactures's Product Specifications for full details on correct procedures.

 

Information regarding product specifications is available from the Manufactures or upon request from ATC.

ATC is not responsible for poor handling, installation, or maintenance. Before and during installation timbers should be kept dry, packed, and undercover please consult the product specifications for more details.

 

TIMBER IS A NATURAL PRODUCT

​

Wood is a natural product, we cannot be held responsible for splitting, warping, discolouration, or tannin bleed of products. Timber contains different colour shades, granular variations and will mature and darken over time. Being natural solid timber, it will move to some degree; this is part of the character of timber and the beauty is that no two pieces are the same.
